Really nothing new here. The DOJ has long presumed it is illigal under the wire act and others but they have yet to prosecute any individual for online gambling to my knowledge. They have of course prosecuted the companies/individuals receiving the wagers.
If the wire act were ammended to include the internet I would be more convinced. There are solid arguments against the stance that they take at the moment and until it goes to court they are really just blowing smoke.
